The following evidences support the charges against Tolokonnikova N., charged with an alleged criminal act:
the testimony of the complainant I. *** D. *** C. *** concerning the fact that since the year 2010 he has been working as the head of the Department of the All-Russian public movement People's Council. One of the main tasks of this public movement is the patriotic education of youth, protection of traditional spiritual and moral values, providing humanitarian aid to large or poor Russian families, and establishing and maintaining clubs to carry out work on the restoration of our nation's significant historical events, and many other things. He joined the above-mentioned organization only because he fully agrees with the opinions of the members. He is also an Orthodox believer who knows the basic prayers, observes fasts and religious holidays, and he is familiar with the church statute.
On 21 February 2012 at about 11: 20 he entered the shop of the Cathedral of Christ the Savior to buy some church items and, having walked through a metal detector, heard calls for help: to be more exact, workers of the Cathedral were shouting: "Security, help!". With security guards he rushed into the Cathedral and saw the following: a few girls in colourful masks with slits for their eyes and mouths, inappropriately dressed in clothing which revealed their arms, thus violating the Church rules, stood near the altar in the soleí area which is also prohibited by the rules of the Church. Aforementioned girls behaved defiantly, shouted offensive words against the church, the Patriarch and the Orthodox faith as a whole. They spastically waved their hands and moved their legs, danced and hopped - all in all their behavior was inappropriate to say the least, and they broke virtually every conceivable and inconceivable common rule of conduct in the Cathedral. He felt hurt and insulted. His first thoughts prompted him to stop the desecration of this Holy place immediately. Such inappropriate behavior insulted his feelings as a believer, and also the feelings of other Orthodox citizens who were asking for help and end to these offensive actions. Moreover, some of the people were even crying. He decided to help the guards because he saw that they would not be able to resolve this unpleasant situation alone. When he ran up to the dancing girls and tried to remove the nearest one to him from the solei, who kept dancing, the girl dropped onto her knees and started crossing herself in front of the Altar and Holy Doors; by doing so she caused even more indignation, anger and offence; for this reason an unknown man and he lifted her up to her feet and removed her from the soleí. When they were bringing the girl towards the exit of the Cathedral, holding her hands, a guard, who was walking towards them, removed a blue hat from this improperly-behaving girl who was being taken away from the church. After that he could see her face.
Then he returned, with a view to continuing to assist in the curbing of these atrocities that were insulting his religious feelings. He again returned to the desecrated place; however, his help was no longer needed because the girls had already left the soleí. At that moment he saw one more girl; she already had her hat removed. He returned to the church shop to buy some church items. At that moment he saw the girls running out of the building.
While he was watching the girls who were dancing and offending Orthodox believers with their appearance and actions, unknown individuals were making videos of the dancing persons in spite of prohibitions. As for the people who were recording, he could only remember a foreigner (Frenchman, representing France-Presse newspaper) and New Paper reporter Lena with whom he went to the Khamovniki District Ministry the Department of the Interior in Moscow. According to Lena she was in the Cathedral for an assignment given by the editorial department and had to cover the event; however, she did not record anything because she also felt insulted.
On the Internet he saw a video with the above-mentioned acts of the girls, violating the Church rules and offending the religious feelings of believers, one of them being that very girl whom he had removed from the Cathedral. The acts which the above-mentioned girls committed in the Cathedral of Christ the Savior, and also the subtitled video of a so-called song with some parts of these recordings are insulting and unpleasant (each piece independently and as a whole) for him as an Orthodox and for all the other believers who therefore suffered non-pecuniary damage. All of this they executed to excite negative and even more insulting public response reflected in the feelings and souls of believing people, to provoke believers to commit questionable acts and excite the following feelings: anger, rage, and hatred, which brings even more heartache from what had happened a week before the fast.
Later he found out that above-mentioned acts were executed by Tolokonnikova N. and Alekhina M. in the group with others.

Testimony of the complainant S. *** L. *** A. *** concerning the fact that since the year 2007 she had been coming to the Cathedral of Christ the Savior and since October 2011 has had a job in the aforementioned Cathedral as a general worker. She is responsible for keeping candlesticks in order, taking care of icon lamps and dusting icons in the Cathedral. A sacristan Mikhail Ryazantsev (Archpriest of the Cathedral of Christ the Savior) had signed an employment agreement with her, thus she was working under his managment. She is a deeply religious Orthodox and deliberately went to serve in the Cathedral. She is also engaged in catechesis, i.e., she is a deeply religious person, and according to her faith - God is the source of all the things necessary for improvement [in one’s life]; she feels it and with the help of God tries to put this exact idea across to other people who find themselves in difficult situations or search for the path to God.
Usually her working day starts at 9 am and ends at 7 pm. The temple opens at 10 am and closes for visitors at 6 am, however, if the service is not finished, there may be exceptions, so the Cathedral is open for purpose longer and her working day becomes longer as well and lasts until the whole Cathedral is clean. All of this is in reference to the Christ the Savior Cathedral. Outside the Cathedral, the Church of the Lord's Transfiguration is located. On 21 February 2012 she came to work at 9 am as usual. At or about 11 am she was standing in the hall of Christ the Savior Cathedral on the right side of the altar, near the candlesticks, her back turned to the altar. At that moment she heard some noise made by several agitated people and out of the corner of her eye saw the little door open. She turned towards the altar and saw a group of unknown girls dressed in relatively decent clothing permissible for a visit to the Cathedral. Being aware of the inadmissibility of their actions on opening the door and entering that part of the Cathedral closed to visitors, she rushed towards this group of girls, warning them that it was forbidden to trespass this area and tried to stop them. The named girls ignored her warnings: one of them, whose shoulder she tried to grab, brushed her hand aside, and together with the rest rushed to the doors that were fencing off the soleí, opened them carelessly and ran to the ambon in front the Holy Doors of the altar. She rushed after them and stopped on the steps of the soleí since no woman, including she as an employee, is allowed to go further than the ambon by the Holy Doors. While this group of girls, staying at the Sacred place of worship, was doing things unimaginable and deeply insulting for believers, namely,
tossing down the backpacks and bags that they had with them, removing their relatively acceptable clothing, taking off and putting on their heads colourful masks with slits for their mouths and eyes, remaining in obscene and vulgar clothing (in short dresses that revealed arms, and in tight leggings);
at the same time they removed the case of the electric guitar
and began demonically to jerk their bodies, jump, hop, lift their legs up high and waggle their heads, at the same time shouting very insulting and blasphemous words directed to Christ, Mother Mary and the Patriarch.
All the actions described and their actions in front of the Holy Doors were executed quickly, smoothly and almost at the same time; this was carried out under the command of one girl from this group, therefore, it suggests that their activities were well-planned with the objective of carrying out this provocation and the individuals were fully aware of what they were doing.
In order quickly to stop these abusive and religiously hateful activities, which were disregarding the feelings of Orthodox people, she started to call out for help. The acts being continued on the ambon in front of the Holy Doors seriously shocked her; she could not believe that something like this could happen in the country's most important Sanctuary, which is the Cathedral of Christ the Savior - a monument built in gratitude for God's help in the victory during the war of 1812.
She saw how the altar wardens and security guards were pushing the group of girls out from the ambon. Having turned around she also saw two persons (a man and woman) standing in the prohibited and specially fenced-off from visitors area: the man was executing prohibited acts i.e., filming (people are asked not to do that when they enter) the above-mentioned group of demonically dancing young women who were being forced out by altar wardens and security guards individuals, and he also was recording everything what was happening.
She approached the young man who was doing the recording and the young lady (approx. 20-22 years old) who stood near him, and, told them that secular people were not allowed at this place and, requesting them to stop recording, forced them out to the other side of the fence. The above-mentioned people were leaving slowly, continuing to film what was happening, including her. Nevertheless, she still managed to force them to the other side of the fence. Behind the fence she saw some more people standing, who were recording. These individuals she also demanded to stop recording and started forcing them out towards the exit. Pleased and relieved to see that the ambon was clean and that there was nobody standing in front of the Holy Doors, she returned to her work duties, still emotional about what had happened.
On the Internet she saw a video with the above-mentioned acts the girls committed which violate Church rules and offend religious people. The acts these girls committed in the Cathedral of Christ the Savior, and also the subtitled video of a so-called song with some parts of these recordings being insulting and unpleasant for her as an Orthodox and all the other believers, therefore, she experienced non-pecuniary damage.
All of this they did collectively to excite negative and even more insulting public response reflected in the feelings and souls of believing people, to provoke believers to commit questionable acts and excite the following feelings: anger, rage, and hatred, which brought to her even more heartache a week before the fast.
Later she found out that the above-mentioned acts had been executed by Tolokonnikova N. and Alekhina M. together with others.

Testimony of the complainant B. *** S. *** N. *** concerning the fact that in June 2002 he was accepted for employment as a security guard for the private security company Kolokol (at present the name is changed to private security company Kolokol-A ), responsible for the guarding of the Cathedral of Christ the Saviour. He provides protection inside the premises of the Cathedral of Christ the Savior. His employment duties include direct safe-keeping of the Cathedral territory, executing pass control at the entrance to the Cathedral to allow in congregants who are dressed accordingly and behave as set out in the Church rules. His responsibilities also include the foreseeing of and prevention of violations of public order and taking measures to remove from the Cathedral the individuals who violate public order and rules of the Church and the Cathedral.
On 21 2012 at 10:00 he took up his duty to protect the Cathedral together with P *** V. V. Sh.*** S. A. and the senior guard responsible for the quarters in the Upper Cathedral K.*** O. A.. At about 11: 00 on 21 February 2012 he took the duty to enforce law and order inside the Cathedral, namely by the quarters #8.
Around 11: 15. he was distracted by a group of foreign tourists on the western side of the Cathedral, furthermore, they had cameras, while it was prohibited to use them in the Cathedral. He stayed near the above mentioned group and made sure they did not take any photos. At that moment he heard screaming, "Security! Security! Security", and turned around to see that the candle lady S.*** L. A. was trying to restrain and prevent a group of unknown girls who were heading towards the soleí from entering the Cathedral. S. *** L. A. could not hold them back, so then the girls ran to the soleí in front of the Holy Doors, removed their outer clothing, remaining in immodest, colourful and defiant dresses, put on colourful masked hats with slits for eyes and mouths. One of the girls dressed in her white bathrobe or dress removed the case of the electric guitar and started hooking it up. As there were around 5 girls in masks and only one of them had a guitar, he made a decision to stop the actions of the girl with a guitar. Out of the corner of his eye he saw camera flashlights and realized that the acts of the above-mentioned girls were provocative. He quickly approached the girl with a guitar who stood in the soleí area and put one hand on her guitar. With the other hand in which he had his portable radio, he was pushing her a little, trying to take her to the soleí exit and behind the fence, plus, at the same time he was calling for help, using his portable radio. An unknown girl began to break free and snatched the radio from his hand, so he threw the guitar on the floor and took the radio back from her. Addressing the girls standing on the soleí he demanded that they leave the soleí, go outside of the fence, and stop their indecent (for the Cathedral) actions. His demands were ignored; the girls would not leave the soleí. Then he took the guitar and the girl who had it and started getting her closer towards the gate and behind the fence. When he brought her outside of the fence, P.*** V. V. came to help since the unknown girl resisted and tried to escape and return to the soleí. Together with his colleague he took her out of the Cathedral to the metal detector, where P.*** V. V. remained with the girl, while he returned to the Cathedral to help others remove the remaining perpetrators. Moreover, when he, together with P.*** V.V., was removing the known girl, someone took her masked hat off and he could see her and remember her face. Later the aforementioned girl turned out to be Catherine Samutsevic Stanislavovna. While he, together with P.** V. V., was bringing out Samucevič C. he turned round once or twice and saw girls jerking their bodies by the soleí, lifting their legs, screaming insulting words and blaspheming the Lord, which also included shouting: "Holy Shit!" and "Mother Mary, become a feminist!" Moreover, one of the congregants and altar wardens were trying to take out these girls who ran from them around the soleí, continuing to commit unlawful and prohibited acts.
He saw how one of the congregants, together with V.*** S. V., was carrying out the girl who had her mask taken off - this girl along with the others had danced on the soleí and also behaved defiantly and offensively towards the Cathedral. He remembered the face of this girl who later turned out to be Maria Vladimirovna Alekhina. Approaching the fence gate he saw another girl in a green dress needing to be removed, her masked hat was taken off her face and put on her head, which allowed him to see her face. This girl was taken to the gate whereafter she went on her own towards the Cathedral exit. Later this girl turned out to be Nadezhda Andreevna Tolokonnikova.
Describing the actions of the rowdy girls he revealed the following: 5 girls in colored masks with slits for their eyes and mouths wore the clothing which violates Church rules. In short-sleeved dresses they stayed near the altar in the soleí area, which is also prohibited by the Church rules. The mentioned girls behaved defiantly, shouted offensive words addressed to the Lord, spastically waved their hands and moved their legs, danced and hopped - all in all their behaviour was inappropriate, to say the least, and they virtually broke every conceivable and inconceivable common rule and this shocked him. He believes that these actions are a desecration of the Holy place. Such inappropriate behavior offended him as an Orthodox believer and other Orthodox citizens who were asking for help and to end these offensive actions, which he in effect did. He, as an Orthodox Christian, suffered non-pecuniary damage, offensive to his religious feelings. When he and other Cathedral wardens were removing the girls who were dancing and offending Orthodox believers with their look and actions, unknown individuals were making videos of the dancing and shouting rowdy girls in spite of prohibitions. At the entrance people are informed that it is prohibited to record videos or take pictures in the Cathedral, the guards also warn visitors with photo and video cameras. In this particular case prohibitions and demands to stop video recording and picture taking were ignored by some people in the Cathedral.
Subject to the shift supervisor instructions he took steps to detain all the participants who were taking part in illegal activities and were recording them. He was able to obstruct only three individuals who presumably were taking photos and recording videos, and the girls managed to escape. The indicated individuals were holding photo and video cameras. Personally he did not see how they were filming.
On the Internet he saw a video with the above-mentioned acts of the girls who violated the Church rules and hurt religious feelings, one of them he had removed from the Cathedral. The acts, above-mentioned girls committed in the Cathedral of Christ the Savior, and also the subtitled video of a so-called song with some parts of these recordings being insulting and unpleasant for him as an Orthodox and all the other believers who, therefore, suffered non-pecuniary damage from it.
Later he found out that above mentioned acts were executed by Tolokonnikova N. and Alekhina M. and Samucevič C. in the group with others.

(vol. 2 record page 248-252) - Testimony of the complainant V.*** S. *** V. *** concerning the fact that since January 2011 he has been working for the Foundation of the Christ the Savior Cathedral as a deputy of the head power engineer. His duties include organizing the operation of electrical systems of the Cathedral complex and the management of subordinate units. By faith he is an Orthodox Christian, baptized in his childhood, he identifies himself with religious people.
On 21 February 2012 at about 11:20 a.m. he witnessed four girls in colorful masks with slits for their eyes and mouths, wearing dresses with sleeves that revealed arms, thus violating the Church rules, stood nearby the altar in the soleí area and behaved defiantly, shouting some words and spastically waving their hands, moving their legs, dancing and hopping. Their behavior was inappropriate and actually broke every imaginable and unimaginable conventional Church rule. Such inappropriate behavior insulted him as a believer, and also other Orthodox citizens who were asking for help and to put an end to these offensive actions. Moreover, some of the people were even crying. He approached one of the girls, who continued to dance and was not paying any attention to the indignant shouts of the churchgoers, forcibly took her by hand and walked her to the exit. Walking her to the exit he removed her hat and saw her face, later this girl turned out to be Maria Vladimirovna Alekhina.
On the Internet he saw a video with the above-mentioned acts of the girls, violating the Church rules and hurting religious feelings of believers, one of them was that very girl who he had removed from the Cathedral. The acts which the above-mentioned girls committed in the Cathedral of Christ the Savior, and also the subtitled video of a so-called song with some parts of these recordings are insulting and unpleasant for him as an Orthodox and all the other believers who, therefore, suffered non-pecuniary damage from it.
Later he learned that the above-mentioned criminal acts had been performed by Alekhina M. in a group with others. N. and the accused Alekhina M. in which the complainant confirmed his earlier given testimony, indicating that Tolokonnikova N. was a perpetrator who on 21 February 2012 together with Alekhina, M., Samucevič C. and others committed the criminal acts in the Cathedral of Christ the Savior. (vol. 2 record page 268-273) - The testimony of the complainant Zh.*** P.*** A.*** concerning the fact that he is an Orthodox. He considers himself to be a deeply religious man who goes to church, observes fasts and religious holidays, participates in church ordinances, professes Orthodox faith and observes all the doctrines and ceremonies of the Orthodox Church.
In the light of his faith and philosophy, he went for religious education for the purpose of becoming a clergyman later. Since 2006 he has been working in the Cathedral of Christ the Savior as an altar warden. His responsibilities include: preparing everything for the service, participation in the service, executing priest orders and performing other duties connected with the liturgy. Besides under authority of sacristan in the Christ the Savior Cathedral - Archpriest Mikhail Ryazantsev - he became a catechist-teacher, i.e., responsible for educational work in the Cathedral.
On 21 February 2012 he arrived to the Cathedral by 7 a.m. and began his usual activities doing preparations for the service. Around 11 a.m. he heard female shouting coming from the central part of the Cathedral; someone was calling for help. Thereafter, having walked through the Northern part of the altar gallery, he came to the central part of the Cathedral and saw four girls on the ambon, jumping, lifting their legs and waving their arms. In the area of the Cathedral, which is fenced off from visitors, in front of the ambon, nearby the stairs, stood about 3 to 4 photographers taking pictures of the girls’ actions.
Since the actions committed by previously-mentioned girls are sacrilegious, blasphemous and desecrate the Cathedral, as the Holy place, he being a believer and an altar warden was insulted by these actions and decided to immediately stop these horrific actions. He ran to the girl who wore an orange mask with slits for her eyes and mouth and demanded that she ends these defiant and offensive acts. However, the girl completely ignored him and continued to dance and jerk her body. Then he took her hand and tried removing her from the ambon. The previously named girl brushed him away and escaped, and then she ran to the other side of the ambon and continued her odious action - dancing with other girls. At the same time, all four girls continued dancing, screaming and shouting offensive and profane words against the Lord, namely: "Holy Shit!" These rowdy girls, acting and shouting offensive words stood in close proximity to Holy icons, including the icon of Christ the Savior, to which clergies, not excepting the Patriarch, venerate during the services. After the escape of the girl in the orange hat, other rowdies started mockingly crossing themselves and performing down-to-earth bows, herewith continuing to chant the same blasphemous and insulting words which offend Orthodox people, and he qualifies it as mockery on the Orthodox service.
Together with the other altar warden Ts.*** V.*** he attempted to end the rowdy acts and remove these disturbing girls from the ambon. However, the girls actively resisted while trying to get away, pushing them aside, and by all means showing no desire to end these offensive actions. He saw a man with a camera who was in the part of the Cathedral which is fenced off from visitors and who then came up to the ambon and started recording. According to him the purpose of these girls' behavior was not only to be rowdy, desecrate the Cathedral and offend religious people, but also to document their defiant acts by recording and taking pictures. Later he managed to push the rowdy girl in an orange mask back from the ambon towards the exit. All the disruptive girls had masks (hats) on with slits for eyes and mouths, wherefore their faces were covered. They were dressed in brightly colored tights and short dresses which revealed parts of their body. Previously-mentioned clothing is strictly prohibited in the Cathedral. The girls had provocative dresses specifically to emphasize their disparagement for the church rules and regulations. Their behavior and acts by the ambon, demonstrate that they deliberately desecrated the Cathedral, the Orthodox faith and its traditions. It also shows their hostile attitude to Orthodox believers.
After all the previously-mentioned occurrences, he was, as well as other witnesses of these acts, emotional about what had happened and took it as the desecration of the Cathedral. Thereafter, the acts deeply touched his religious feelings and showed contempt for Orthodox customs and traditions, the believers and to him in particular.
The acts committed in the Christ the Savior Cathedral by the previously-mentioned girls, as well as the video with the text of a so-called song and pieces of the recordings, differ from the acts the girls executed by the ambon. In the video placed on the Internet, one can hear songs with the words which offend religious people, Mother Mary and the Patriarch in particular, moreover political slogans were added. While in the Cathedral itself they only chanted offensive words to the Lord and by their actions neglected feelings of religious people, demonstrating enmity towards the Orthodox faith and believers. Furthermore, in the video, the words insulting to Mother Mary, mimic the liturgical singing, which makes the offence towards the religious people even worse and emphasizes irreverence and contempt for the Orthodox traditions and members of the church. He also pointed out that the movie itself contains shots not recorded in the Cathedral of Christ the Savior but in the Epiphany Cathedral in Moscow (Elohovskij) instead, which before the erection of the Cathedral of Christ the Savior used to be the main Cathedral of the Russian Orthodox Church. In the Epiphany Cathedral shots were taken of girls in colored masks jerking their bodies, singing into a microphone on a long tripod, everything happening in close proximity to Holy icons.
According to him, all of this they did to excite negative and even more insulting public response reflected in the feelings and souls of believing people, to provoke believers to commit questionable acts and excite the following feelings: anger, rage, and hatred, which brings even more heartache because of what had happened the last week of fast. Taking into account all the previously-mentioned occurrences he suffered non-pecuniary damage.
(vol. 1 page record 133-136, vol. 2 record page 174-177) - Testimony of the complainant P *** V.*** V. *** concerning the fact that he is an Orthodox by faith and can identify himself with believers. Since August 2010 he has been working for the private security company Kolokol, which facilitates security for the Cathedral of Christ the Savior. His employment duties include direct safe-keeping of the indicated territory, executing pass control by the entrance to the Cathedral to allow in churchgoers who are dressed accordingly and behave as set out in the Church rules. His responsibilities also include foreseeing and preventing violations of public order and taking measures to put out of the Cathedral the individuals who violate public order and rules of the Church and the Cathedral.
On 21 February 2012 at 10:00 a.m. he took up his duty to protect the Upper Cathedral together with B *** S. N., Sh.*** S. A. and the senior guard responsible for the quarters in the Upper Cathedral K.*** A. A.. At about 11:00 a.m. he took the duty at the entrance by the metal detector shaped like a frame. Previously he stood in the hall; the guards change their positions every hour. From 11:00 to 11:20 a.m. there came no more than 50 people (congregants), so he could take a good look at all of them. He saw an electric guitar which a young man carried with him. The guitar was in a closed case, hanging behind the back. It is not prohibited to bring musical instruments in cases, except large-sized instruments. Within the indicated period there came more than 25 female churchgoers of different age, some of them were young. All the people who passed the inspection and were admitted into the Upper Cathedral were dressed according to the Cathedral requirements for visitors. Moreover, a lot of people with video and photo cameras came inside. These people were allowed in because their video and photo cameras had been kept in their cases. They had been warned in English and in Russian languages that it was not permitted to film inside the Cathedral.
At about 11:20 a.m. he heard calls for help - the Cathedral workers were specifically shouting: "Security! Help!” He asked one of the Cathedral workers who was calling for help to take his place. Together with Sh.*** S. A. he rushed into the Cathedral and saw the following: a few girls in colorful masks with slits for their eyes and mouth, inappropriately dressed in clothing that revealed their arms (thus violating the Church rules) standing nearby the altar on the soleí which was also prohibited by the rules of the Church. The previously-mentioned girls behaved defiantly, shouted some kind of words, spastically waved their arms and moved their legs, danced and hopped. The girls violated all the conceivable and inconceivable common rules. These actions shocked him. Such inappropriate behavior offended him, as an Orthodox believer, and other religious citizens who were asking to stop the rowdy acts. When he ran up to the dancing girls, some of them did not have their masks anymore. He does not know who removed the masks from them. He took by hand a girl unknown to him, who B.*** S. N. (security guard) was trying to remove. She was shouting and waving her arms. The aforementioned girl had her hat removed already. Together with the B *** S. N. he removed the aforementioned girl out of the hall of the Cathedral of Christ the Savior and left her at the entrance, in front of the metal detector. Later this girl turned out to be Samucevič C. Then the candle lady hurried back into the Cathedral and he remained on duty by the entrance and watched how the participants of this "obscurantism" were being removed from the Cathedral. The previously-mentioned girls stood in front of the metal detector and did not make any attempts to enter again. Over time he lost sight of them because churchgoers kept coming in. The Cathedral stayed open so he returned to his duties.
On the Internet he saw a video with the above-mentioned acts the girls committed which violate the Church rules and offend religious people. The acts, the above-mentioned girls committed in the Cathedral of Christ the Savior, and also the subtitled video of a so-called song with some parts of the Cathedral recordings are insulting to him as an Orthodox; therefore he suffered non-pecuniary damage from it.
Later he found out that the previously-mentioned acts were executed by Tolokonnikova N. and Samucevič C. in the group with others.
